Cleaners N16 Service Terms and Conditions
These Terms and Conditions set out the basis on which Cleaners N16 provides cleaning services to residential and commercial customers. By booking or using any of our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means any individual or business that requests or receives services from Cleaners N16.
Company means Cleaners N16, the cleaning service provider.
Services means any cleaning service supplied by the Company, including but not limited to regular domestic cleaning, office cleaning, end of tenancy cleaning, deep cleaning, and related services.
Cleaner means any person engaged by the Company to carry out the Services at the Customer premises.
Premises means the property or location at which the Services are to be provided.
2. Scope of Services
The Company will provide the Services as agreed with the Customer at the time of booking. The scope of work, frequency and duration of each visit will be confirmed during the booking process. The Company reserves the right to amend the scope of Services where necessary for health and safety, practicality or legal compliance.
The Services do not include tasks that may put the Cleaner at risk, including but not limited to working at unsafe heights, lifting excessively heavy items, cleaning exterior windows that require ladders, or handling hazardous materials. The Company also does not undertake pest control, gardening, structural repair, or any tasks that require specialist qualifications or licences.
3. Booking Process
Bookings may be made by the Customer through the Company booking methods as made available from time to time. At the time of booking, the Customer must provide accurate and complete information about the Premises, the type of Service required, preferred dates and times, and any access requirements.
All bookings are subject to availability and are only confirmed when the Company has issued a booking confirmation. Provisional or tentative bookings do not guarantee that a Cleaner will attend. The Company reserves the right to decline a booking without obligation to provide a reason.
The Customer is responsible for ensuring that there is adequate access to the Premises at the agreed time. Where keys or access codes are provided, the Customer must ensure that they are correct and in working order. If a Cleaner is unable to gain access, the visit may be treated as a late cancellation and charges may apply.
4. Customer Obligations
The Customer agrees to provide a safe working environment for the Cleaner, including suitable lighting, ventilation, running water and electricity. The Customer must inform the Company of any known hazards at the Premises, including fragile items, alarm systems, or areas that should not be accessed.
The Customer is responsible for securing valuables and fragile items prior to the Cleaner arrival. The Company will not be liable for pre-existing damage or for damage arising from the condition or poor installation of fixtures, fittings or appliances.
The Customer agrees not to engage or employ any Cleaner introduced by the Company for private or direct work outside of the Company, either during the period of service or within twelve months of the last appointment. If this restriction is breached, the Customer may be liable for a fee representing a reasonable estimate of the loss suffered by the Company.
5. Payments and Pricing
Prices for the Services will be communicated to the Customer before the booking is confirmed. The Company reserves the right to adjust its prices from time to time. Any change to pricing will not affect a confirmed booking that has already been paid for, but may apply to future bookings or ongoing regular services with prior notice.
Payment terms will be set out at the time of booking. The Company may require payment in advance, a deposit, or payment immediately upon completion of the Service. The accepted methods of payment will be specified during the booking process.
If payment is not received in accordance with the agreed terms, the Company reserves the right to charge interest on overdue amounts, to suspend further services until payment is made, and to recover any reasonable costs incurred in pursuing payment. The Customer remains responsible for ensuring that all payments are made on time.
Where a quotation is given based on the Customer description of the Premises and the required Services, the Company reserves the right to adjust the price if the actual condition or size of the Premises is materially different from that described, or if additional tasks are requested on site. Any such adjustment will be discussed with the Customer.
6. Cancellations and Amendments
The Customer may cancel or amend a booking by giving the amount of notice specified by the Company at the time of booking. If the required notice is not given, the Company may charge a cancellation fee, which may be up to the full cost of the scheduled Service, to cover administrative and staffing costs.
If a Cleaner arrives at the Premises and is unable to gain access, or if the Service cannot be carried out due to circumstances within the Customer control, the visit may be treated as a late cancellation and the full fee may be charged.
The Company reserves the right to cancel or reschedule a booking where necessary, for example due to staff illness, operational issues, or circumstances beyond its reasonable control. In such cases, the Company will notify the Customer as soon as reasonably practicable and will offer an alternative appointment. The Company will not be liable for any indirect losses or inconvenience arising from such cancellations.
7. Service Quality and Complaints
The Company aims to provide a high standard of service. If the Customer is dissatisfied with any aspect of the Services, they should raise the issue with the Company promptly, ideally within 24 hours of the Service. This allows the Company to investigate the matter and, where appropriate, to arrange a revisit or other resolution.
Any complaints reported after a significant delay may be harder to verify and the Company reserves the right to decline remedial action in such cases. The Company assessment of the situation will take into account evidence from the Cleaner, any photographs or notes, and any relevant conditions at the Premises.
The Company may, at its discretion, offer a partial refund, discount, or re-clean where it is satisfied that the Services fell below the expected standard. This shall be the Customer exclusive remedy for service quality issues.
8. Customer Property and Keys
Where keys, access cards or codes are provided to the Company for the purpose of attending the Premises, they will be handled with reasonable care. The Company recommends that Customers do not label keys with full addresses for security reasons.
The Company will not be liable for loss or damage arising from incorrect keys, faulty locks, alarm malfunctions, or access issues outside its control. If keys are lost or damaged while in the Company custody, the Company liability will be limited to the reasonable cost of key replacement or lock change, subject to any applicable liability cap set out in these Terms and Conditions.
9. Waste Handling and Environmental Regulations
The Company will handle general household and office waste generated in the course of cleaning in accordance with applicable waste and environmental regulations. Cleaners may place general waste and recycling in the appropriate internal or external bins provided by the Customer at the Premises.
The Company does not provide a removal service for large quantities of waste, bulky items, construction or renovation debris, electrical equipment, or hazardous substances such as chemicals, paints, solvents, medical waste or sharp objects. The Customer is responsible for arranging proper disposal of such items through licensed waste carriers or local authority facilities.
The Customer must ensure that any waste the Cleaner may come into contact with does not contain prohibited or dangerous materials. If a Cleaner reasonably believes that handling certain items would breach health and safety obligations or waste regulations, they are entitled to refuse to deal with those items and to report the issue to the Company.
Where local recycling and waste separation rules apply, the Customer should inform the Company in advance of any specific requirements at the Premises. While the Company will take reasonable care to follow Customer instructions, ultimate responsibility for compliance with site-specific waste rules remains with the Customer.
10. Health and Safety
The Company is committed to maintaining safe working practices. All Cleaners are instructed to follow reasonable health and safety guidelines, including the correct use of cleaning products and equipment.
The Customer must not request that a Cleaner undertakes any task that could compromise their safety or breach applicable health and safety regulations. This includes, but is not limited to, using unsafe ladders, operating machinery they are not trained to use, or handling substances that require specialist controls.
The Company may withdraw Services immediately if it considers that the conditions at the Premises present a serious health or safety risk to the Cleaner. In such cases, the Customer may still be liable for some or all of the scheduled fee, depending on the circumstances.
11. Liability and Insurance
The Company will exercise reasonable skill and care in providing the Services. The Company maintains insurance appropriate to its operations, subject to the terms, conditions and exclusions of the relevant policy or policies.
The Customer must notify the Company of any alleged loss or damage arising from the Services as soon as reasonably possible and, in any event, within a reasonable time after becoming aware of it. The Company may require evidence such as photographs or repair estimates to assess the claim.
The Company will not be liable for normal wear and tear, pre-existing damage, defects or deterioration, or damage resulting from the use of faulty equipment, unstable fittings, or items not suitable for cleaning with standard methods.
To the fullest extent permitted by law, the Company shall not be liable for loss of profits, loss of business, loss of opportunity, or any indirect or consequential loss arising out of or in connection with the Services or these Terms and Conditions.
Subject to any liability that cannot legally be limited or excluded, the total aggregate liability of the Company to the Customer in respect of any and all claims arising out of or in connection with a particular Service shall be limited to the total amount paid by the Customer to the Company for that specific Service.
12. Cleaning Products and Equipment
Unless otherwise agreed, the Company may supply its own cleaning products and basic equipment required to perform the Services. The Customer must inform the Company in advance if they have any allergies, sensitivities, or preferences regarding cleaning products so that reasonable adjustments can be considered.
Where the Customer requests or requires the use of their own products or equipment, the Company accepts no responsibility for the suitability, safety, or performance of those items. Any damage or unsatisfactory results arising from the use of Customer supplied products or equipment will be at the Customer risk.
13. Force Majeure
The Company shall not be in breach of these Terms and Conditions, nor liable for any failure or delay in performing its obligations, if such failure or delay results from events, circumstances or causes beyond its reasonable control. Such events may include extreme weather, utility failures, public transport disruption, strikes, accidents, or public health emergencies.
Where a force majeure event occurs, the Company will use reasonable endeavours to notify the Customer and to reschedule the affected Services as soon as practicable.
14. Data Protection and Privacy
The Company may collect and process personal data about the Customer for the purposes of managing bookings, providing Services, handling payments, and dealing with queries or complaints. The Company will handle such information in accordance with applicable data protection laws.
The Customer is responsible for ensuring that any personal data relating to third parties at the Premises is handled in compliance with applicable laws and that Cleaners are not given access to information that they do not need in order to carry out the Services.
15. Variations to Terms
The Company reserves the right to amend these Terms and Conditions from time to time. Updated terms will take effect when published or otherwise communicated to the Customer. Continued use of the Services after any changes have been notified will constitute acceptance of the updated Terms and Conditions.
No variation to these Terms and Conditions requested by the Customer shall be effective unless expressly agreed in writing by the Company.
16. Governing Law and Jurisdiction
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.
The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of the Services.
17. General Provisions
If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, that provision shall be deemed severed from the remaining provisions, which shall continue in full force and effect.
No failure or delay by the Company in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.
These Terms and Conditions constitute the entire agreement between the Customer and the Company in relation to the Services and supersede any prior agreements, understandings or arrangements, whether written or oral, relating to their subject matter.
